You often have to make an appointment ahead of time, and must present an ID in sort of a “holding room”-type entrance. You’re buzzed in, and typically paired with an employee or “budtender,” who guides you through what’s available, helping match you to the right product.

If you’re after this experience here on Martha’s Vineyard, we’re not quite there yet, but we’re getting close, and the finish line is in sight. There are, of course, mixed reactions about an industry like this finding roots on an Island like this. And like many other communities, the Vineyard can be resistant to change. But at the end of the day, business is business. And when it comes to cannabis, there are not only economic gains to be had for the Island community (towns can receive up to 3 percent in taxes on adult-use purchases), but also added workforce, and — remember, since this stuff is medicine — access to another health option.

If you’ve been following this storyline at all, you know it’s a whiplash of a tale. But amid all of the uncertainties, there has been one constant — and that constant is Geoff Rose.

The cannabis shop that could 

Back when marijuana was legalized for medical use in 2012, Rose was the guy who first saw a place for the industry on Martha’s Vineyard. He launched an LLC, Patient Centric of Martha’s Vineyard, with an overarching mission “to bring safe and responsible use of cannabis to the Island community.”

The business has been divided into three components: the medical/recreational dispensary at 510 State Road in West Tisbury; the cultivation, processing, and testing site at 90 Dr. Fisher Road in West Tisbury; and the recreational shop at 15 Mechanic St. in Vineyard Haven. We’re in a unique position here on Martha’s Vineyard (and on Nantucket), because the plant is still federally illegal, and it cannot be shipped over federal waters or airways. That means all of the growing and product testing must be contained to the Island, which meant Rose had to build a cultivation site and he had to build a testing site. Rose had to navigate a set of “firsts” that arguably no other cannabis entrepreneur in the state has had to (except for possibly on Nantucket).

Rose refers to this business as his 8½-year-old child, and while it’s not yet operational as we go to press with this issue in mid-June, we can confidently say it’s getting there. He’s attended the selectmen and zoning board meetings. He’s answered to abutters. He’s solidified host-community agreements. He’s passed inspections. He even pressed the passage of a bylaw with the help of State Representatives Julian Cyr and Dylan Fernandes so product testing could be done on the Island.

One step closer, another step closer, just a few more steps … and in March 2021, Rose threw us a curveball. To the surprise of many, Rose decided to sell the West Tisbury portions of his business.

In what he calls a “hybrid agreement,” Rose will still maintain ownership of the Vineyard Haven dispensary, he said, but he is handing off the West Tisbury dispensary and processing/cultivation site to a family-owned, Connecticut-based business called Fine Fettle.

“They have the same attitude and operating philosophies as I do,” Rose said. “I thought it made sense for all parties.”

Fine Fettle owns and operates three medical marijuana dispensaries in Connecticut, one adult-use dispensary and one outdoor grow site in Massachusetts, and a processing site in Rhode Island. Prior to its work in the marijuana field, the three-generation family firm operated in addiction-treatment services and philanthropy. It expanded itself to the cannabis industry to build on that mission.

“We always think about [cannabis] from the standpoint of health and wellness,” CEO Benjamin Zachs said, adding that above all else, the company is “committed to partnering with the community.”

“We get it,” Zachs said. “There’s worry about traffic, smell, the changing fabric of a local community. We’re extremely cognizant of this.”

Rose and Zachs were introduced around this time last year through a mutual friend. After talking, Zachs said he was fascinated with the idea of operating a business in a seasonal location like the Vineyard.

“The more I talked to Geoff, the more I liked Geoff, and when we came to visit, we saw he’d built out just a really great facility,” Zachs said. “And that’s a big deal when you’re acquiring something toward the finish line to begin the race.”

Rose said the sale was both financially driven as well as to “lighten the operational responsibilities.” He said he plans to work closely with Fine Fettle, and will be buying wholesale product from them.

I asked Rose and Zachs what they thought about some of the community pushback that arose after news broke that a portion of the business was being sold to an off-Island company.

Rose played it straight: “I don’t listen to the criticism of the community of my selling the business.”

“You know, I read some of the comments,” Zachs said. “People saying, ‘This big company is coming.’ And I’m like, ‘Are we the big company people are talking about?’”

Fine Fettle has about 75 employees across three states, 68 of whom work in the dispensaries and cultivation sites. Zachs anticipates that on the Island, there will be seven to 12 full-time, year-round jobs in cultivation, and six to eight full-time, year-round jobs in the dispensary. He anticipates staffing up a bit more during the summer months to handle traffic. Zachs said he aims to hire as locally as possible, and plans to retain all or as much of Rose’s existing staff as wants to stay onboard.

Massachusetts has strict rules around the number of dispensaries that an operator can manage: a company can only have control of three. Since Fine Fettle now has two — in West Tisbury and in Rowley — it can still open one more somewhere in the state, and Zachs said he plans to. “We just haven’t picked out where yet,” he said.

And while there are operational challenges to opening a business like this on Martha’s Vineyard, Zachs seems to be focused on the positives.

“On the mainland, there can be a backlog on testing. But because our testing is done onsite and our dispensary is [a few miles] down the road, we may be able to have the freshest product available,” Zachs said. “I’m really excited that we can create products people are going to want to come visit for.”

As far as opening, the Cannabis Control Commission recently approved the change of ownership from Rose to Zachs. Now, Fine Fettle will have to schedule and pass a post-final license inspection. Zachs hopes the medical dispensary will be open for business by June, and recreational sales will go live by late-July. “There are still a few CCC elements we need to finalize,” Zachs said.

For Rose and the Vineyard Haven dispensary, which he said will be called “Island Time,” the hope is that the business will be up and running by the first week in August, as it also needs to pass additional inspections and CCC approvals.

Looking back at the last near-decade as he’s watched his child grow, Rose said, he’s proud. “Along the way you’re dealt certain cards, and you have to realize you have influences locally and from the state — you just have to continue to reassess how you move forward,” Rose said. “It hasn’t been a straight line, but I’m very pleased with what I’ve accomplished.”

The issue of whether lobsters feel pain when dropped into a cooking pot of boiling water is long-simmering. Though live cooking of lobsters has been banned in Switzerland (2018) and New Zealand (1999), based on that presumption, most scientists say empirical evidence that crustaceans are sensitive or can even detect temperature changes is far from clear.

A study at Queen’s University in Belfast, published in 2013, exposed the claws of shore crabs (Carcinus maenas) to electrical shocks. The crabs learned to avoid them, a behavior the study authors said was “consistent with key criteria for pain experience.”

A 2015 study at the University of Texas-Pan American found that Louisiana red swamp crayfish (Procambarus clarkii) displayed nociceptive behavior (responses to extreme temperatures) when briefly touched by a soldering iron at 129 degrees Fahrenheit, but not to low temperature or chemical stimuli, such as capsaicin, the active component in chili peppers.

The University of Texas authors concluded the crayfish possessed some nociceptive behaviors, but cautioned against over-interpreting the results. “We wish to be clear that we are not claiming crustaceans generally, or even crayfish specifically, feel pain,” they wrote. “We are claiming that crayfish detect and respond to noxious high temperature stimuli in ways that they do not to other potentially noxious stimuli.”

Michael A. Taffe, PhD, professor in the Department of Psychiatry at UC San Diego School of Medicine and senior author of the newest study, and colleagues had already documented in 2016 that inhaled THC produced anti-nociceptive effects in rats, blocking pain detection, and reduced the rodents’ body temperature and physical activity. Given the restauranteur’s claims, they were curious whether THC acted similarly upon lobsters, which are a well-established animal model for neurological research.

“Lobster models have contributed much to our understanding of neurotransmission and neuronal circuits,” said Taffe, “most notably in the work of (Brandeis University neuroscientist) Eve Marder, who began her work when she was a graduate student at UC San Diego.”

Though primarily an aquatic species, lobsters are able to survive for hours to days out of water if their gills (located inside their carapace or shell) remain moist enough to function. The UC San Diego researchers set up a sealed tank in which residing lobsters would be exposed to carefully calibrated levels of vaporized THC for 30 or 60 minutes.

The scientists subsequently measured levels of THC in tissue samples from some of the lobsters, including gills, brain, heart, liver, tail and claw. Claw samples where boiled for 10 minutes to determine if THC levels were reduced or eliminated by cooking.

The behaviors of other lobsters were monitored before and after THC exposure for changes, such as more or less time spent moving around, distance traveled and speed. Lobsters also had their claws and tails dipped in water ranging in temperature from ambient to 118 degrees Fahrenheit for up to 15 seconds. (Human showers typically range in water temperature from 105 to 112 degrees F.)

Taffe said the results were mixed. The primary finding was that Maine lobsters are capable of absorbing vaporized THC into their bodies by gill respiration, based on tissue samples. They also exhibited less locomotor activity, similarly to THC-exposed rodents. Responses to different water temperatures varied: the warmer the water, the more rapidly the lobsters moved their claws, tail or antennae away from the liquid, but THC exposure had very minimal effect on detection of a hot water stimulus in the study.

“This is the first direct evidence of thermal nociception in lobsters,” said Taffe.

But does that constitute feeling pain? Taffe and colleagues cannot say with certainty: Detection of a stimulus is not synonymous with pain. Lobsters responded to THC exposure much less dramatically than rodents in both behavior and response to adverse stimuli.

“The assertions of the restaurateur that lobsters can be affected by vaping cannabinoids appears confirmed by their subsequent behavior,” said Taffe, “but the impact of THC on thermal nociception was minimal. You would need to do more experimentation to fully investigate behavioral outcomes, including anxiety-like measures, which we did not address.”

Though the results are described as “mixed,” the researchers did find that THC was absorbed into the lobsters’ bodies from breathing and that their behaviors changed toward being less active. The study likewise involved putting lobsters’ claws in water ranging from 105F to 118F for up to 15 seconds to see how they’d react.

The vaporized THC didn’t have much of an effect on whether the lobsters could detect the water’s heat; the researchers noted that the hotter the water, the more rapidly the lobsters moved away from it. Whether that means they can feel pain, however, remains a mystery. Ultimately, the study concluded that THC exposure did change the lobsters’ behavior, but had little effect on how they responded to hot water.

Live updates: Jasiel Correia co-conspirator Tony Costa sentenced to 3 years probation – Fall River Herald News

BOSTON — Tony Costa, a Fall River businessman who pleaded guilty for his part in former Fall River mayor Jasiel Correia’s marijuana extortion schemes is scheduled to be sentenced today.

Costa will be appearing before U.S. District Court Judge Douglas Woodlock at the John Joseph Moakley U.S. Courthouse. U.S. Assistant Attorneys Zachary Hafer and David Tobin have asked for no prison time for Costa, who they said in a filing was instrumental in their prosecution of Correia on 21 out of 24 criminal counts. 

Prosecutors are asking Woodlock to sentence him to three years of probation, the first 15 months to be served in home confinement, 200 hours of community service in Fall River, a $50,000 fine, $107,550 in forfeiture (the money he received in the extortion scheme) and a $500 mandatory special assessment.  

Costa’s cooperation, said prosecutors in their memorandum, led to the knowledge of the degree of extortion and the number of marijuana businessmen who had been shaken down by Correia and the role of the middlemen. 

Costa and co-defendants Hildegar Camara, of Fall River; and David Hebert, of Westport, pleaded guilty separately in plea agreements to extortion and providing false statements to investigators in September 2019 and have been awaiting sentencing.

Ealier this month, Woodlock rejected the c plea deal for Correia’s former chief of staff Gen Andrade, essentially saying as a public official she needed to serve some time for her part in Correia’s corrupt plans. 

At Correia’s trial, Costa testified he took a $100,000 check from one of four marijuana vendors in exhchangefor a letter of non-opposition and a community host agreement from Correia. He told the jury that he kept $30,000 for himself. 

He also testified to his role in a second extortion from a marijuana vendor where he kept all of the approximately $77,500 in cash and illegal marijuana in the bribe for himself.  Costa also illuminated the jury on his gift to the then-mayor for the now-infamous “Batman” Rolex watch as a gift for piping work at one of his many city properties paid for by city taxpayers on Correia’s order.

Woodlock thumbed through the pre-sentencing reports and memos. He said family members have requested to speak. Zachary Hafer said that he is “not walking away from our plea agreement” but he is not objecting to the sentencing guidelines

Costa was deemed eligible for probation, a range of fine, and they’re offering forfeiture/restitution

Woodlock brings up the question of Costa’s truthfulness in his testimony. Specifically, he said Costa did not remember the names of people he was dealing with in his drug dealings. Sine it was not raised by the government itself, Woodlock said he treated it as impeachment. Second, Woodlock mentioned the portion of Costa’s testimony about playing both sides saying he used the funds for a cruise with elderly women. 

Woodlock asked the prosecution whether they believe Costa was being truthful when he testified as such.

Hafer said that he thought Costa was not being untruthful, bc Costa had testified he used money for “savings, whatever.” Woodlock asked whether any investigation was done to find the specifics of this “whatever.” “We were satisfied that once he admitted that he took it for himself … that was an acknowledgment that he was using it personally”

Judge asks if government investigated where he spent or used the bribe money he took in the extortion scheme.

The nine elderly women remark draws a chuckle, & Woodlock says that bit of testimony strikes him as “anomalous.” Woodlock: “About the nine elderly women. … Do you know anything more about what that’s about?”

Hafer said he believes it was Costa’s mother and friends. 

Woodlock said he will not make any further adjustments to the calculations made in the pre-sentencing report. Absent a reduction for ‘responsible” Woodlock said the the offense level guidelines would have been 97 to 120 months in prison. There are a range of crimes for which Costa has not been charged according to the plea agreement, including money laundering, and so sentencing for those is “off the table.”

Woodlock again said that he feels that criminal activity involving accomplices should necessitate “a period of incarceration”

He said he wants to address the Gen Andrade case and is taking into consideration his role in the Correia corruption case regarding his cooperation.

Woodlock said, “this is a pretty dramatic reward for the cooperation the defendant had … in my experience that’s quite unusual. … Without Mr. Costa, there wouldn’t have been a case.”

Woodlock mentions a portion of the memorandum that states defendant’s mother will stop working July 1. He questions what that mean in terms of what she will be able to do; Woodlock said he understands Costa works day and night. He questions whether that prescribes any period of incarceration and why. 

You’ve put your finger on it: This is a substantial request from us, said Hafer. “These are very, very serious crimes, among the most serious we prosecute.”

“This is a case that was going to be driven by immunized testimony and honest testimony… It wasn’t until we had Mr Costa could we put the money in the mayor’s hands,” said Hafer. 

“In our view it was the opening of the floodgates,” said Hafer. “His cooperation was extraordinary.”

Hafer again mentions that they’ve included a significant period of community service in the recommendations. He said the sentencing puts out the message that when you have the kind of info Costa had on a public official you have to come forward. 

Hafer said he tried to balance Costa’s cooperation and to incentivize others to come forward in future corruption cases.

This is significant because for the first time this gives an inside look at HOW the Correia case was developed — no wires, no video evidence, really just people’s testimony, and nobody wanted to testify.

Woodlock: “this is quite striking, the award of recognition”

So far there are 69 participants watching the Zoom sentencing hearing. 

Woodlock mentioned the bribery charge that the jury did not find Correia guilty on regarding the Batman Rolex. Hafer said he thinks the jury did believe Costa’s testimony.

Woodlock adds, “Costa comes in, and does the right thing, how do you reward that?”

Woodlock questions the 100 hours of community service recommendation and makes a comparison to the Varsity Blues college admissions cases for which he levied 300 hours per year.

Hafer: “…no golf, no dinners … that’s a significant restraint of liberty.”

Costa’s lawyer Daniel Rabinovitz, brings up that unlike the Varsity Blues case, Costa is essentially a blue collar worker. 

Woodlock fires back stating that distinguishing crime based on economic circumstance is fraught with problems. Woodlock doesn’t seem to care what “collar” you have, everybody should be treated the same.

Woodlock said Costa did have advantage: something to trade: privileged access to the city of Fall River through Correia. “And he traded on it.” 

Rabinovitz said with respect to what he’s allowed to do outside of work will be totally different. Defense attorney argued that home confinement will be totally different for Costa who works and it will be very different for him to be unable to fix roofs etc.

“He’s not only working long hours, he’s physically working hard,” said Rabinovitz. It’s more punishment for him to have home confinement… It is punishment to work and go home and do nothing else..”

Woodlock asked why someone else out in the field couldn’t do Costa’s work. Rabinovitz said he only has “One helper in the field and one helper in an office setting.” 

Woodlock again appears to question what is so unusual in Costa’s life. “Everybody has a family everybody’s family has needs,” said Woodlock. 

Rabinovitz says Costa has “a 76-year-old mother and a disabled adult [his sister]” who are dependent on him. Costa’s mother and disabled sister are in the court and want to speak on his behalf and how they rely on him.

Rabinovitz said he intends to sell a property to pay for the forfeiture. 

Costa speaks briefly apologizes to the court and the judge for his actions. 

Woodlock: there will be a period of probation 3 years. First 15 months home confinement, he will continue to do his work, medical appointments and religious concerns. Subject to a monitoring by electronic device and pay for the cost of the device. The nature of his business is such that it’s possible for him to out and about. Establish curfew 7 am. to 8 pm. other than that, has to be approved by probation office. Impose 100 hours of community service. I have in my mind 100 hours each year of probation. This is mean to be the hard work to the community of fall river: cleaning, cooking, services within institutions. Not meant to be being a greeter at some worthy institution. Fine $10,000 forfeiture $107,000 (roughly money Costa was able to extract illegally.” 

Woodlock: I view this as an an exceptionally serious offense. What we have here is a group of people who played on the privilege of access. It plays on what our sense of what a community is… to get things done. Rather than playing on both sides. 

Typically, Woodlock said he would have imposed some prison time in a case like this. Apart from recognizing nature of characteristics of defendant: blue shirt, white collar, no collar. “Costa is a hard-working man,” he added. “A man who picks himself up by the bootstraps and comes to this country and contributes to the economic life of the country… But he also had another business: dealing drugs. But he admitted to it. It’s a little mixed but it’s important to have that kind of recognition.” 

In speaking to the issue of deterrence, Woodlock said, “He’ll never have a partner like Mr. Correia again.”

Woodlock mentioned Correia also continued to commit crimes while under investigation and indictment.

“Ultimately he did testify at trial …and it did ostracize him in the community,” said Woodlock of Costa.
